Is this Malpractice?

Ok, so it all started on August 16. My family and I got inot a carcrash which left my mom with her left leg broken. The first thing the doctors did was put on an external fixature, then a cast and then a brace. Now 3 months have gone by and the doctors find that there is a 10 degree deviation in her bone. In other words, it’s crooked. They said that they would have to re break it and put it into another fixature. But we are speculating where it all went wrong. We think it was when my mom went to have the brace put on and the doctor there said that the instructions where confusing and he just guessed what brace to put on my mom. Now we have the crooked leg problem. I’m just wondering if this is malpractice and what we should do.
But the problem is that 1 month after the break, the doctor told her to walk on her left leg even if it wasn’t healed.

  1. This in no way sounds like a malpractice case to me. I don’t believe any of this would hold up in court as there is no proof that the deviated leg was caused by a brace and not the injury. And it is also unlikely that the doctor ‘guessed’ which brace to put on.

    Edit: The fact the doctor told her to walk on it is no malpractice. I would have told her the same thing as that is part of rehabilitation. You can bring it to the court but you will just be wasting your time and money and the time of a doctor that could be helping others.

  2. Sounds like just bad luck to me, not malpractice. My son broke his femur in a car accident. He had surgery with an IM nail screws put in. After 6 months, he had no healing. Another surgery, bigger nail screws. This also ended in a non-union. He still wasn’t healing properly. The back of the bone had healed abit, but the front was nowhere close. He was finally referred to an Orthopedic Trauma Surgeon.
    My son ended up with removal of his hardware, an osteotomy (surgical re-break) a bone graft a new plate screws.
    The trauma surgeon couldn’t find a reason for his not healing. Everything was done correctly with the first surgeon.
    Anywho, my son had 6 surgeries it took 3 years for his leg to heal.

  3. sheesh..real sorry 2 hear abt. your mom. but i m not really on 2 this q n ans bit..tho i wud have helped out if i cud..no clue 2 this mal practice bit..but do take care..will pray 4 your mom.
